Amended complaint filed in suit over falling bathroom cabinet

GALVESTON - A Texas City man who filed a lawsuit after a bathroom cabinet fell on his head recently edited his original petition.

Jose Jaime-Delgado revised the suit against Dimos Vervitas on May 11 to include an additional defendant as well as new lines in the first complaint, which was filed April 3.

According to court papers, Jaime-Delgado's alleged injuries were caused by Vervitas's failure to make repairs to the plaintiff's unit at Velami Apartments after Hurricane Ike.

A large cabinet originally affixed to the bathroom wall collapsed on the complainant on Jan. 5, 2011, the suit says.

Jaime-Delgado, his wife and children lived at the defendant's apartments since August 2008.

The subject property, however, reportedly sustained storm damages during Ike's landfall on Sept. 13, 2008.

The complainant explains that he was promised that the apartment was suitable for human habitation, but water leaked into the unit and he was repeatedly prompted to make requests for repairs or a move into another apartment.

The alleged incident inflicted injuries upon Jaime-Delgado which required surgery, the suit says.

Jaime-Delgado's amended petition lists B & S Housing, LLC as another respondent and adds how the plaintiff suffered two ruptured lumbar discs and other "severe" physical injuries.

His list of claims was rewritten to say both defendants allegedly engaged in wrongdoing and misconduct which led to the subject event.

Vervitas provided an original answer April 19.
