Trailer company sues to recoup $340,000

GALVESTON - Utility Trailer Sales South East Texas Inc. has filed suit in an effort to recoup approximately $340,000 from a Friendswood couple.

Recent court documents filed May 23 in Galveston County District Court show Joe and Bridget Reyes owe the plaintiff $336,989.99.

According to the original petition, Rey-Con Industrial Ltd., which is not a party to the suit, executed a credit application for parts and service with the complainant on April 5, 2011, with Joe Reyes executing a personal guarantee included in the documentation.

"The effect of the personal guarantee is that the defendants personally guaranteed payment of all amounts due and owing by Rey-Con Industrial, Ltd. to the plaintiff," the suit says.

"As the defendants are husband and wife, the obligations set forth under the personal guarantee are community obligations."

Rey-Con purchased parts and materials to the tune of $644,858.85 from the complainant under the credit application.

The company made partial payments on the account, but failed to continue making payments, the suit says.

"At the time Rey-Con Industrial, Ltd. stopped making payments on the account, it owed the plaintiff $436,410.86, as set forth on the statement and invoice," the suit says.

Some of the parts and materials sold under the credit application were returned after the supposed default, which left the disputed $336,989.99 due and owing.

The plaintiff says it tried to resolve the matter in an amicable manner to no avail as the parties did not reach any agreement.

Attorney Steven T. Parker of Kemah is representing the complainant, and Galveston County 56th District Court Judge Lonnie Cox is presiding over the case.
