GALVESTON - Alleging the warranty on his vehicle was breached, League City local James Hershey filed a lawsuit.
Hershey's suit against Gay Buick GMC Inc. and United Service Protection Inc., filed May 30 in Galveston County District Court, says the defendants misrepresented to him that his warranty would cover major damages to his 2008 Ford F-250 pickup truck.
Recent court documents show the plaintiff purchased a preferred protection plan-high mileage program from Gay Buick GMC in Dickinson on Aug. 23, 2011.
Two months later, Hershey began to experience engine problems and was prompted to take the truck to McRee Ford, another dealership in Dickinson, for repairs.
He was informed that the engine had been damaged "to such an extent that the entire engine would need replacement."
Hershey then contacted USP for warranty coverage.
The suit further explains that a USP representative came out to inspect the vehicle and determined the warranty would not cover the subject damage.
"(The plaintiff) was also told that the warranty was invalid because it was not sold in conjunction with the purchase of the vehicle," it states.
Hershey adds he was forced to repair the engine to the tune of approximately $20,000.

Galveston County 212th District Court Judge Susan Criss is presiding over the case.
