Suit filed over collapse at Santa Fe school

GALVESTON - A Montgomery County man claims he was injured last year while working at a construction site at a local high school, recent court documents say.

Cody Key is suing ICI Construction Inc., Harbor America Central Inc., Harbor America Holdings Inc. and Consolidated Crane and Rigging after he sustained injuries during the collapse of the Santa Fe High School auditorium.

Two other workers were hurt in the incident on March 18, 2011.

According to the original petition filed June 18 in Galveston County District Court, the collapse, presumably brought on by falling beams, fractured Key's vertebrae and injured his head, neck, right leg and back.

The suit insists the plaintiff "did not have actual knowledge of the unreasonably dangerous condition", asserting the respondents "(failed) to warn the plaintiff of this known unreasonably dangerous condition and (failed) to make the unreasonably dangerous condition reasonably safe."

The suit blames the defendants for:

  • Failing to maintain a safe premises;
  • Failing to protect Key;
  • Failing to properly secure and maintain equipment; and
  • Failing to inspect the premises for latent defects.

    
Consequently, the plaintiff sues for physical pain, mental anguish, physical impairment and disfigurement, lost wages and medical expenses.

    A jury trial is requested.

    Galveston County 405th District Court Judge Wayne Mallia is presiding over the case.
