MARSHALL - A woman has filed a lawsuit against a home improvement store claiming that they should have warned that about the possibility of a rug falling and hitting her in the head.
Kimberly Riggs filed suit against Lowe's Companies Inc. on July 20 in the Eastern District of Texas, Marshall Division.
The accident occurred on Nov. 8, 2011, as Riggs was shopping at the Lowe's store in Mount Pleasant. She states that she suffered a serious injury when a rug fell and struck her head.
The defendant is accused of negligence and negligence per se for failing to properly inspect the premises to discover the dangerous condition, failing to properly maintain the premises, failing to give warning to Riggs of the unsafe condition, failing to give adequate and understandable warnings, failing to maintain the rug in a stable and secured location and for failing to secure the rug to prevent it from falling.
The plaintiff is seeking damages for medical expenses, physical pain and suffering, mental anguish, physical impairment, physical disfigurement, loss of earning capacity, interest and court costs.

A jury trial is requested.
