Suit arising from $35K in unpaid Internet marketing invoices filed

GALVESTON - Xtreme Dealer Solutions LLC claims Houston resident Lee Mehta and Strickland Chevrolet Inc. in Pearland have an outstanding debt totaling near $35,000, recent court documents say.

A lawsuit filed Aug. 29 in Galveston County District Court states Mehta and Strickland failed to pay XDS $34,565 for services pertaining to Internet marketing and review analysis performed earlier this year.

The parties entered into a contract last Jan. 5 which required XDS to provide links to auto dealers' "Grade My Dealer" surveys, monthly reports of all surveys, opportunities for dealers to rectify negative surveys before they are posted, confirmation of survey accuracy, delivery of survey to Internet searches and rotating banner on the home page of "Grade My Dealer," all to the tune of $1,965 per month for a 6-month term beginning Jan. 5, 2012.

The respondents also inked an agreement with XDS for XPOD services which included but not limited to URLs for each XPOD, landing pages for each XPOD, monthly reports detailing traffic to and from each XPOD and multiple first-page Google results at the cost of $1,800 per month for a one-year term beginning Mar. 13, 2012.

According to the suit, the defendants "are more than 90 days past due" on its payments dating back to the May invoice while "the plaintiff has continued to fulfill its commitments" under the contract.

XDS insists that it incurred "significant" costs including support, updates, monitoring and use of available technology resources.

Efforts to recoup the back payments and protect the complainant's business interests were unsuccessful as the defendants failed to respond to a written letter and e-mail demanding remittance, the original petition says.

Galveston County 56th District Court Judge Lonnie Cox is presiding over the case.
