SHERMAN - A Plano man is suing a debt collector after he received two telephone calls a day for several months.
Michael Johnson filed suit against Max Revenue Solutions on Aug. 28 in the Eastern District of Texas, Sherman Division.
According to the lawsuit, in April 2012, the defendant began contacting Johnson in an attempt to collect a debt. Max Revenue Solutions placed two calls daily to Johnson’s cellular phone. Johnson states that he requested validation of the debt and for the defendant to stop calling him.
The defendant allegedly continued to place the collection telephone calls despite receiving Johnson’s request.
Max Revenue Solutions is accused of violating the Fair Debt Collection Practices Act and the Texas Debt Collection Act by engaging in harassment and abusive tactics.
The defendant is also accused of invasion of privacy by intrusion into private affairs.
The plaintiff is asking the Court for an award of actual damages, statutory damages, court costs, attorney’s fees and punitive damages.
Johnson is represented by Jody B. Burton of Lemberg & Associates in Stamford, Conn. A jury trial is requested.
U.S. District Judge Ron Clark is assigned to the case.
