Laboratory worker files lawsuit claiming employer violated federal wage laws

SHERMAN - A clinical laboratory worker has filed a lawsuit against his employer claiming he was fired for complaining about the company violating federal wage laws. 

Bradley W. Pruden filed suit against Med Fusion on Nov. 7 in the Eastern District of Texas, Sherman Division.

Pruden was hired by the defendant for the position of field service specialist in March.  According to the lawsuit, in June, the defendant reduced Pruden’s paycheck without prior notification.  Pruden spoke to the human resources department and sent a written notice that he believed the defendant’s actions were contrary to law.

Pruden was successful at obtaining his missing wages. However, he states the defendant began to systematically retaliate against him for reporting his good faith belief of being incorrectly paid under the Fair Labor Standard Act.

The defendant is also accused of withholding a commission check from Pruden and creating a hostile work environment.

Pruden was terminated on June 21, 2012 allegedly for his performance.

The defendant is accused of violating the Fair Labor Standard Act and for deliberately and intentionally retaliating against and ultimately wrongfully discharged Pruden.

The plaintiff is seeking an award of damages for mental anguish, emotional distress, lost wages, employee benefits, loss of wages capacity, attorney’s fees, exemplary damages, interest and court costs.

Pruden is represented by H. Dustin Fillmore III, Charles W. Fillmore and R. Layne Rouse of The Fillmore Law Firm in Fort Worth. A jury trial is requested.

U.S. District Judge Richard A. Schell is assigned to the case.
