TEXARKANA- A maintenance supervisor has filed a lawsuit against the owners of the hotel where he worked claiming he was not paid overtime wages in violation of federal law.
Larry Rush filed the lawsuit against William E. Davis and Roxann K. Davis on Nov. 27 in the Eastern District of Texas, Texarkana Division.
The defendants are the directors and owners of the hotel where Rush was previously employed.
Rush was employed as a maintenance supervisor at their hotel from approximately March through June of 2010. Rush states that he was paid a salary, minus a certain amount per week for lodging.
According to the lawsuit, he regularly worked in excess of 40 hours a week, but was not paid at one-and-a-half times the regular rate of pay for the overtime hours.
Rush complained about the lack of overtime wages and was terminated from his position.
The defendant is accused of violating the Fair Labor Standards Act.
The plaintiff is seeking an award of damages for lost wages, liquidated damages, front pay, punitive damages, court costs, attorney’s fees and interest.

A jury trial is requested.
U.S. District Judge Michael H. Schneider is assigned to the case.
