Debt collection agency sued for calling debtor before 8 a.m.

SHERMAN - A debt collection agency is being sued for allegedly calling a man several times before 8 a.m., which is a violation of the Fair Debt Collection Practices Act. 

Jeffrey Brown filed suit against EOS CCA on Nov. 29 in the Eastern District of Texas, Sherman Division.

According to the lawsuit, Brown incurred a debt to AT&T and the debt was purchased by EOS CCA. Brown states that the defendant attempted to collect the debt by placing several calls a day to Brown’s cellular phone.  The telephone calls occurred before 8 a.m.

The defendant is accused of violating the Fair Debt Collection Practices Act and the Texas Debt Collection Act by engaging in behavior of which was to harass, oppress, or abuse the plaintiff in connection with the collection of a debt.

The plaintiff is asking for an award of damages, statutory damages, court costs, attorney’s fees, and punitive damages.

Brown is represented by Jody B. Burton of Lemberg & Associates in Stamford, Conn. A jury trial is requested.

U.S. District Judge Ron Clark is assigned to the case.
