Shelby County man sues Louisiana business following collision in Panola County

MARSHALL - A Shelby County man has filed a lawsuit against a Louisiana business claiming that an employee drove into his vehicle.

Terry Williams filed suit against Kenneth Wayne Dowden, Larry Alexander and Scooters Inc. on Nov. 29 in the Eastern District of Texas, Marshall Division.

The incident occurred on June 20 as Williams was driving his 2005 Dodge Stratus and was traveling northbound on US 50 in the inside lane and stopped for the red light behind another vehicle.

According to the suit, defendant Dowden, who was driving a 2000 International truck, drove his truck from the center median and collided into Williams’ vehicle. Defendant Dowden’s truck was owned by defendant Alexander and Scooters.

Williams states that a result of the collision he suffered injuries to his neck, shoulders, back and left hip.

The defendant is accused of negligence and negligence per se for failing to yield right of way, failing to properly apply brakes in order to avoid the collision, failing to keep a proper lookout, for driving in a reckless manner and for turning when unsafe.

The plaintiff is seeking an award of damages for physical pain, suffering, mental anguish, medical expenses, physical impairment, loss of earnings, loss of earning capacity, physical disfigurement, interest and court costs.

Williams is represented by Jeff B. Badders of Badders Law Firm PC in Nacogdoches.  A jury trial is requested.

U.S. District Judge Rodney Gilstrap is assigned to the case.
