MARSHALL - The former Student Activities Coordinator of an East Texas college has filed a lawsuit claiming that he was terminated after he complained about racial discrimination.
Orlandrus Kelly filed suit against Texas State Technical College in Marshall on Dec. 26 in the Eastern District of Texas, Marshall Division.
Kelly, an African-American, was employed by TSTC as the Coordinator for Student Activities. In December 2010, Kelly filed a charge of racial discrimination.
He claims that after he filed the charge of discrimination, he began to be more closely scrutinized by his supervisor in a discriminatory fashion.
Kelly was terminated in March 29, 2011.
The defendant is accused of:
• “Unlawful and systematic exclusion of and discrimination” against Kelly by failing to equalize employment conditions;
• Adopting unreasonable, unwarranted and arbitrary standards and conditions of employment and advancement;
• Failing to promote Kelly to a higher and better paying position in the same manner as comparably trained non-African-American employees; and
• Retaliating against Kelly for filing a charge of discriminating with the U.S. Equal Employment Opportunity Commission.
The plaintiff is seeking an award of damages for back pay, interest, compensatory damages, attorney’s fees and court costs.
Kelly is represented by Tyler attorney William S. Hommel Jr. A jury trial is requested.
