Galveston tenant files lawsuit after fall from apartment roof

HOUSTON - After he purportedly sustained "life-threatening" injuries from a fall a few months ago, Brandon Jones has filed a lawsuit.

Jones is suing Richard Jarvis, White Star Properties LP and Residual Construction Inc. over the incident that occurred on Oct. 20, 2012.

Recent court documents filed Dec. 28 in Galveston County Court at Law No. 2 state that the plaintiff fell from the roof of his Galveston apartment which he was renting from the defendants.

According to Jones, he was sitting in a chair on the rooftop when the chair broke and he fell two stories.

The suit claims the terrace area lacked railing, stating the complainant hurt his head, face, back, neck and other parts of his body.

It insists the respondents "allowed the terrace area to fall into a state of disrepair or faulty function without any safeguards in place to prevent a fall."

Jones additionally points out that "a door led to this area on the roof and there was no railing or barriers in place to protect residents who accessed the area."

"The defendant(s) failed to provide any reasonably [safe] measures to provide [a] safe environment that would have prevented a fall," the original petition says.

Consequently, he seeks unspecified monetary damages and a jury trial.

Attorney Kurt B. Arnold with Arnold & Itkin LLP in Houston is representing Jones.

Galveston County Court at Law No. 2 Judge Barbara Roberts is presiding over the case.
