Bus driver sues nursing home after tripping over pallet

MARSHALL - A bus driver for a nursing home has filed a lawsuit claiming that he tripped and fell over a pallet that had been placed outside of the nursing home facility while he was inside picking up a patient.

Billy Jordan filed suit against Panola 501 Partners LP, individually and doing business as Panola Nursing & Rehabilitation Center, on Jan. 9 in the Eastern District of Texas, Marshall Division.

Jordan states he was injured on Jan. 12, 2011, when he fell at the Panola Nursing & Rehabilitation Center in Carthage. The incident occurred while Jordan was working for Alliance Health Management and transporting patients.

He entered the defendant’s Center through the ambulance door and was exiting through the same door when he tripped and fell on a pallet that had been place outside the doorway, the suit states.

The defendants are accused of negligence and premises liability for creating a dangerous condition on the defendant’s premises, for failing to remove the dangerous condition, failing to warn of the dangerous condition, and for failing to adequately inspect the defendant’s premises for the dangerous condition created.

The plaintiff is seeking an award of damages for pain, anguish, physical impairment, loss of earning capacity, medical expenses, interest and court costs.

U.S. District Judge Rodney Gilstrap is assigned to the case.
