Brookshire resident sues Calif. men over 2012 wreck in Austin Co.

HOUSTON - A Brookshire man seeks damages over an auto collision in Austin County last year, recent court documents say. 

Francisco Echevarria sued San Bernardino County, Calif., residents Jose L. Pulido and Manuel Acosta, doing business as Acosta Transport, on Sept. 4, 2012 in Waller County District Court.

The case was removed to the Houston Division of the Southern District of Texas on Feb. 21.

According to the suit, Echevarria was traveling along FM 3013 near Oil Field Road outside of Bellville when the defendants, who were operating a tractor-truck, "attempted to make a U-turn under dangerous foggy conditions" and caused the subject accident.

Echevarria says the apparent impact inflicted "substantial" damage to his vehicle as well as "significant" injuries to his head, neck, back and other parts of his body, adding he is currently undergoing extensive medical treatment.

He faults the respondents for:


  • Failed to control the tractor-truck's speed;

  • Failed to operate said tractor-truck safely;

  • Failed to keep a proper lookout;

  • Failed to properly train their driver;

  • Failing to change lanes safely;

  • Performing an illegal U-turn; and

  • Failing to maintain a safe distance.


Meanwhile, Acosta and his business are blamed for negligent training, retention, supervision and entrustment.

A jury trial is requested.
