Maintenance worker sues for overtime wages

SHERMAN - A maintenance worker has filed a lawsuit against his former employer claiming the company failed to pay him overtime wages in violation of federal law. 

Ernest Johnson filed suit against JRK Residential Group Inc. on March 18 in the Eastern District of Texas, Sherman Division.

Johnson worked for the defendant from Nov. 2011 through June 2012 as a maintenance worker. During his employment, he states that he worked in excess of 40 hours in a week and was not paid overtime wages.

The defendant is accused of violating the Fair Labor Standards Act by failing to pay Johnson overtime compensation for hours worked in excess of 40 per workweek.

The plaintiff is seeking an award of actual and compensatory damages for overtime compensation, liquidated damages, attorney’s fees, interest and court costs.

Johnson is represented by Charles L. Scalise of Ross Law Group in Austin. A jury trial is requested.

U.S. District Judge Richard A. Schell is assigned to the case.
