East Texas company asks court to prevent $70,000 refund of truck

MARSHALL - An East Texas company has filed a lawsuit to prevent a Minnesota company from trying to obtain a $70,000 refund for a used 2008 Ford bucket truck. 

Nirow Inc. filed suit against One Way Tree Services Inc. and Christopher Storlie on March 28 in the Eastern District of Texas, Marshall Division.

According to the suit, on Jan. 14 Nirow sold to the defendants two 2008 Ford bucket trucks “as is” with no warranties. The defendants claim that the trucks broke down on the way back to Minnesota and that one truck has numerous problems. The defendants have made a demand for $70,000 for the purchase price of the truck.

Nirow is asking the court to issue a judgment declaring that the defendants have no right to return the purchase price for the sale of the 2008 Ford bucket truck and no right to reimbursement for repairs made to the truck. Nirow is asking for an award of court costs and attorney’s fees.

The plaintiff is represented by Scott C. Skelton of Zeleskey Law Firm PLLC in Lufkin.
