Katy woman sued over accident insists 'she was acting under an emergency'

GALVESTON - A Katy woman slapped with litigation over a February 2011 two-vehicle accident in Galveston formally denies the plaintiff's claims, recent court records show. 

Danielle Stephens alleges Lori Jane Curtis caused the Feb. 5, 2011, collision between them.

Stephens's lawsuit, filed earlier this year before the Galveston County 10th District Court, explains that Curtis ignored a set of red flashing lights at the intersection of Twelve Mile Road and FM 3005, and connected with the plaintiff's vehicle.

The original petition shows Stephens was waiting at the four-way stop when the subject wreck occurred, asserting the purported impact left her with an injured right arm, left arm, left shoulder, left hip, left leg, left upper body and neck.

Curtis filed an original answer March 8 arguing she "was acting under an emergency and acted as a reasonable, prudent person would have acted under the same or similar emergency."

According to the four-page rebuttal, the collision was "unavoidable as that term is known in law."

It further disputes the price tag of the medical treatment Stephens reportedly received following the wreck.
