GALVESTON - A two-vehicle collision in Texas City two years ago between two local residents and a Palacios man has spawned a lawsuit.
In recent court documents filed April 5 in Galveston County District Court, Dennis James Savoie and Richard Savoie blame Hector Garcia for the April 10, 2011, incident in question.
The original petition states the plaintiffs were traveling northbound in the 2200 block of FM 2004 near the Mall of the Mainland prior to the wreck.
Meanwhile, Garcia drove south on the same roadway.
The defendant tried to turn east into the mall parking lot, crossing the complainants' lane, the suit says.
It adds the plaintiffs attempted to veer left to avoid colliding with the respondent, "but could not, striking the back right quarter of the defendant with the right front of [their] vehicle."
Medical treatment was subsequently administered to the complainants.
Garcia is faulted for:
- Failing to keep a proper lookout;
- Failing to turn his vehicle to the left or right in an effort to avoid the accident;
- Failing to maintain a clear and reasonable distance; and
- Failing to apply his brakes.
Consequently, the plaintiffs seek unspecified monetary damages.
They are represented by attorney Thomas P. Nixon of Houston.
Galveston County 405th District Court Judge Michelle Slaughter is presiding over the case.
