Bicyclist's lawsuit claims League City motorist struck him near intersection

GALVESTON - A local bicyclist claims he was involved in an auto accident in League City two years ago in which the alleged impact sent him into in the path of oncoming traffic.

In recent court documents filed April 15 in Galveston County Court at Law No. 3, Dylan Chudleigh accuses League City resident Mark Curnell Martin of causing the Apr. 19, 2011, wreck between them.

Chudleigh was riding his bicycle in a westerly direction on the eastbound shoulder in the 6000 block of FM 518, also known as West Main Street, prior to the collision in question.

Meanwhile, Martin was waiting at a stop sign at the intersection of West Main and Maple Leaf Drive.

The original petition alleges the defendant "negligently" pulled out ahead on West Main and struck Chudleigh as he attempted to cross Maple Leaf.

The complainant adds he was catapulted into the air and ended up in the middle of the inside lane of the two eastbound lanes of a busy Main Street.

"The rear wheel of the plaintiff's bicycle was impacted by the front driver's side fender of the defendant's vehicle near the middle of the crossway of Maple Leaf Drive," the suit says.

Martin is blamed for:


  • Failing to keep a proper lookout;

  • Failing to pay attention;

  • Failing to make a proper right turn; and

  • Failing to yield the right of way.


Consequently, the plaintiff seeks no more than $100,000 in damages as well as a jury trial.

He is represented by attorney G. Stephen Chudleigh of League City.

The case has been assigned to Galveston County Court at Law No. 3 Judge Christopher Dupuy.
