Male store manager claims wrongful termination for reporting female supervisor’s sexual advances

LUFKIN - A male Dollar General store manager has filed a lawsuit claiming he was terminated for reporting sexual harassment by his female supervisor. 

Dale Lasneski filed suit against Dolgencorp of Texas and Dolgencorp Inc., doing business as Dollar General Store, on March 15 in Tyler County District Court. The defendant removed the case to the Eastern District of Texas, Lufkin Division on April 18.

According to the suit, Lasneski was hired by the defendant as a manager-trainee at the Dollar General store in Jasper. He claims that his supervisor treated male employees differently than their female co-workers. According to the lawsuit, the supervisor made sexual advances towards Lasneski, which he reported to the District Manager to no avail.

He was terminated on Jan. 13, 2011, allegedly due to his sex, age and in retaliation for reporting his sexual harassment.

The defendant is accused of retaliation and sex and age discrimination in violation of the Texas Labor Code.

The defendant is also accused of misclassifying Lasneski as a manager in order to keep from paying him overtime wages as required by the Fair Labor Standards Act.

The plaintiff is asking the court to issue a permanent injunction stopping the defendant from continuing to violate Lasneski’s rights and for an award of damages for back pay, compensatory damages for mental anguish, exemplary damages, liquidated damages, interest, attorney’s fees and court costs.

Lasneski is represented by Houston attorney Ashok Bail. A jury trial is requested.

U.S. District Judge Ron Clark is assigned to the case.
