GALVESTON - Claiming she was hit by a car while going back to work at a Galveston store about two years ago, Texas City local Nina Garcia pursues legal action.
Recent court documents filed May 10 in Galveston County District Court blame Houston resident Ross Dillon Ward for the May 12, 2011, auto-pedestrian accident.
Garcia says she was walking across a parking lot to re-enter the Big Lots where she works at the time of the incident in question.
According to the plaintiff, a vehicle driven by Ward struck her suddenly and without warning.
The lawsuit faults the motorist for:
- Failing to keep a proper lookout;
- Failing to yield;
- Failing to turn said vehicle away;
- Failing to maintain a clear and reasonable distance between the complainant and himself;
- Failing to obey the speed limit; and
- Failing to apply the brakes.
Joining Ward as a respondent is Bastrop County resident Michelle Crossley.
The suit asserts the vehicle that purportedly caused the collision belonged to Crossley, who is accused of negligent entrustment.
Consequently, Garcia seeks unspecified monetary damages and a jury trial.
She is represented by attorney Paul H. LaValle of the Law Office of Paul Houston LaValle & Associates, P.C. in Texas City.
Galveston County 122nd District Court Judge John Ellisor is presiding over the litigation.
