HOUSTON - A California woman alleges she was a passenger in a two-vehicle accident which reportedly sent her vehicle into a light pole, recent court papers say.
Donna Mendes filed suit against Fort Bend County resident Daniel Thomas Sawyer over the Aug. 14, 2011, incident in the Houston Division of the Southern District of Texas on June 18.
Mendes's vehicle was traveling near the intersection of Bellaire Boulevard and the Grand Parkway at the time of the subject collision.
According to the lawsuit, Sawyer "ignored a red light, ran it and crashed with the plaintiff's vehicle causing it to strike the light pole and totaled the rented vehicle."
It adds Mendes sustained injuries to her face, left foot and general body for which she was transported to Memorial Hermann Katy Hospital.
She says that she required surgery and cortisone shots to her ankle, physical therapy and pain medications.
Sawyer is faulted for:
- Failing to obey a controlled traffic signal light;
- Failing to maintain proper control of his vehicle;
- Failing to control his speed;
- Failing to maintain a proper lookout; and
- Failing to timely apply brakes.
A jury trial is requested.
