Anderson County woman sues after slipping while shopping

MARSHALL - An Anderson County woman has filed a lawsuit claiming she was injured when she slipped while shopping and fell.

Maria Martinez filed suit against Wal-Mart Stores on July 3 in Eastern District of Texas, Marshall Division. 

The accident occurred on March 26, 2013 while Martinez was shopping and slipped on a substance that had been left on the floor.

The defendant is accused of negligence for failing to maintain the floor of the store in a reasonably safe condition, for allowing slick substances to accumulate on and remain on the floor of the store, failing to warn Martinez of the danger presented by the presence of the slick substances on the floor, and failing to inspect the floor for water, fluid and other debris or slick substances on the floor.

The plaintiff is seeking an award of damages for loss of earnings and earning capacity, medical expenses, physical pain and mental anguish, physical impairment, disfigurement, court costs, interest, punitive damages, and attorney’s fees.

Martinez is represented by Tyler attorney Luke Bickham. A jury trial is requested.
