HOUSTON - After Safway Services LLC allegedly fired him for being "old and slow," Harris County resident Henry Roach has filed a lawsuit.
Roach initiated legal action against his former employer in Harris County District Court last month.
The case was transferred to the Houston Division of the Southern District of Texas on July 16.
Driving Momentum Inc., a temporary staffing agency, placed the then-58-year-old Roach with the defendant in the summer of 2011.
He worked for the company through the agency for three months and was directly hired in August 2011.
Shortly after he came aboard, according to the suit, a supervisor named Eric Sanchez subjected him to a hostile work environment.
The plaintiff met with Sanchez, who is not a defendant in the litigation, and a dispatcher in late September 2011 to learn he was fired.
Sanchez bluntly told Driving Momentum that the respondent terminated Roach because of his age, the suit says.
Consequently, the complainant sues for mental anguish and lost wages.
A jury trial is requested.
Attorney Marc J. Wojciechowski of Wojciechowski & Associates, P.C. in Spring is representing Roach.
