Collin Co. man sues debt collector for threatening to file lawsuit

SHERMAN - A Collin County man has filed a lawsuit against a debt collector for violating federal law by threatening to file a lawsuit in order to collect a debt.

Brandon Lottie filed suit against Audubon Financial Bureau and Travelers Casualty and Surety Co. of America on Aug. 12 in the Eastern District of Texas, Sherman Division. 

Lottie incurred a debt that went into default and was placed with Audubon for collection. Lottie states he disputes the debt and sent Audubon a notice to cease all further communication. However, collection calls continued with a collector warning that a judicial proceeding had been or soon would be started against Lottie.

The defendants are accused of violating the Fair Debt Collection Practices Act and the Texas Finance Code and for invasion of privacy.

The plaintiff is seeking an award of actual damages, statutory damages, attorney’s fees, and court costs.

Lottie is represented by Rockwall attorney Jeff Wood. A jury trial is requested.

U.S. District Judge Richard A. Schell is assigned to the case.
