Lawsuit says Dickinson motorist caused wreck by running stop sign

GALVESTON - A collision almost two years ago is the focus of a San Leon couple's lawsuit.

In court papers filed Aug. 29 in Galveston County District Court, William Bates and Patricia Ann Cherepes claim that Dickinson local Philip Gentry caused the Sept. 6, 2011, crash between he and Bates.

They seek at least $1 million in damages.

Bates was traveling southbound on Calder Drive in League City and was trying to turn eastbound onto Link Road.

The suit adds that Gentry failed to yield to Bates's vehicle, which was already on Link.

"The plaintiff was already in the intersection, and had the right of way, when the defendant's negligent conduct caused the severe collision," the original petition says.

It additionally accuses the respondent of failing to keep a safe lookout, failing to look both ways before entering the intersection and failing to obey a stop sign.

A jury trial is requested.

Attorney Terry Bryant of Terry Bryant PLLC in Houston is representing the complainants, and Galveston County 122nd District Court Judge John Ellisor is presiding over the litigation.
