Landscape laborer sues former employer for overtime wages

SHERMAN - A landscape laborer has filed a lawsuit against his former employer claiming that the Lewisville company failed to pay him overtime wages. 

Austin Lyon filed suit against Green Thumb Landscaping on Aug. 27 in the Eastern District of Texas, Sherman Division.

Lyon worked for the defendant as a laborer from February 2011 through February 2013. He claims that during his employment he worked in excess of 40 hours, but was not paid one and one-half times his regular rate of pay for each overtime hour worked.

The defendant is accused of willful violating the Fair Labor Standards Act.

The plaintiff is seeking an award of damages, attorney’s fees, interest and court costs.

Lyon is represented by Jonathan Sandstrom Hill and Charles L. Scalise of Ross Law Group in Austin. A jury trial is requested.

U.S. District Judge Richard A. Schell is assigned to the case.
