Federal judge's order shuts Houston woman's lawsuit against La. tractor-trailer driver

HOUSTON - A Houston woman's lawsuit arising from a two-vehicle accident near the University of Houston earlier this year was tossed by a federal judge.

U.S. District Court Judge Nancy F. Atlas signed an order of dismissal Sept. 9 and entered it into Whitney Houston's lawsuit against Greensburg, La., resident Jarvis R. Payton and his employer, Landis Transport LLC.

In the suit filed in Harris County District Court and subsequently turned over to Houston federal court, Houston explained that she was traveling northbound in approximately the 4800 block of the Spur 5 feeder road last Feb. 6 when she collided with Payton’s commercial tractor-trailer.

The tractor-trailer was “negligently stopped and parked in the right lane of the poorly lit highway,” according to the plaintiff, who claimed to have suffered severe injuries as well as significant damage to her vehicle and property.

Court records show the suit was disposed June 24 after Judge Atlas approved the plaintiff's motion to dismiss only to be reopened so the defendants can express any opposition.

Judge Atlas's order says the respondents "failed to file a response in opposition."
