Motorist alleges tractor-trailer ignored right-of-way, crashed into vehicle

GALVESTON - A two-vehicle accident in Pasadena last month prompted John L. Elliott to seek damages.

In a lawsuit filed Sept. 11 in the Galveston Division of the Southern District of Texas, Elliott targets Trailer Transit Inc. for the collision in question last Aug. 19 near the intersection of Pasadena Boulevard and Highway 225.

Elliott was traveling southbound in the 100 block of Pasadena Boulevard near the 900 block of the Pasadena Freeway.

Meanwhile, according to the original petition, Ahmed G. Hussein was operating a tractor-trailer belonging to TTI when "suddenly and without warning" he turned into Elliott's path and caused the subject wreck.

The suit states that the impact with the tractor-trailer left the plaintiff with serious personal injuries.

Through his employer, Hussein, who is not a defendant, is blamed for:

  • Failing to yield the right-of-way;

  • Failing to maintain a proper lookout;

  • Failing to make a timely application of the brakes; and

  • Failing to take evasive action to avoid the collision.

A jury trial is requested.

Attorney Timothy R. Hightower of Hightower, Russo & Capellan in Houston is representing Elliott.
