Collin County woman sues debt collector for message implying lawsuit was filed

SHERMAN - A Collin County woman has filed a lawsuit against a debt collector for leading her to believe that it was filing a lawsuit against her for an outstanding debt.

Yuliya Sindiy filed suit against SKC Financial on Oct. 24 in the Eastern District of Texas, Sherman Division. 

Sindiy states that she had an account that went into default and was transferred to the defendant for collection. She claims she requested the defendant cease all further communication on the account, but the defendant continued to attempt to collect on the account.

In a message left for Sindiy, an employee of the defendant left a message causing the plaintiff to believe that a lawsuit had been filed against her, Sindiy's suit alleges.

“Defendant’s conduct was so outrageous in character, and so extreme in degree, as to go beyond all possible bounds of decency, and to be regarded as atrocious, and utterly intolerable in a civilized community,” the lawsuit states.

The defendant is accused of violating the Fair Debt Collection Practices Act and the Texas Finance Code.

The plaintiff is seeking an award of actual, statutory, and exemplary damages, attorney’s fees and court costs.

Sindiy is represented by Jeff Wood of The Wood Firm in Rockwall. A jury trial is requested.
