HOUSTON - Jacobs Field Services North America Inc. denied the allegations detailed in a recent discrimination lawsuit against it.
The company submitted a motion to dismiss into Kennewick, Wash., resident Michael A. Cannon's suit on Oct. 15, according to court records.
As previously reported, Cannon sued Jacobs in August for rescinding a job offer to him, allegedly because of his disability.
Jacobs withdrew its field engineer job offer to the plaintiff when it learned he could not use his right arm, the original petition claims.
Though Cannon insisted he "could use his left arm" if he needed to reach above his head as well as climb a vertical ladder without a problem, it adds, the respondent junked his candidacy.
Cannon further shows that Jacobs “failed to reinstate the job offer or discuss any accommodation even after all of this information was provided.”
Jacobs's seven-page motion states the complainant, however, failed to field a failure-to-accommodate claim or exhaust his administrative remedies.
The document asserts Cannon "expressly denied that he sought or needed any accommodations."
