Dragon Products sues, alleging business disparagement

Dragon Products is suing over claims the defendant committed business disparagement and unfair competition.

Dragon Products Ltd filed a lawsuit Nov. 1 in the District Court of Jefferson County 172nd Judicial District against Medlen Oil Field Transport Inc., doing business as Cuttings Removal Co., and Boxrite LLC, citing business disparagement and unfair competition.

Dragon says it manufactures and sells enclosed dump trailers with sliding doors over the top and an end dump door. According to the complaint, Dragon has sold these trailers to Siboney Energy Services.

The plaintiff alleges that sometime after Aug. 6, a letter was sent from Cuttings Removal Co. to Siboney's customers stating that Siboney was infringing a patent by using Dragon's trailers. The letter stated Cuttings Removal Co. has exclusive right to make, use or sell anything covered by the patent, according to the complaint.

The complaint states that Cuttings Removal Co.'s allegations regarding the patent are false and the defendant sent the false statements to interfere with Siboney's business relationships and in turn to assert rights against Dragon.

The plaintiff is seeking an undetermined amount of damages, including an injunction. Dragon is being represented by J. Hoke Peacock II of Orgain, Bell & Tucker LLP.
