GALVESTON - An insurance company has filed a lawsuit on behalf of a Dickinson couple in response to an alleged water leak.
In court papers filed Nov. 15 in Galveston County District Court, State Farm Lloyds Insurance Co. blames the incident on a flexible toilet water supply line made and sold by Interline Brands Inc., Linx Limited, Watts Water Technologies Inc. and Watts Plumbing Technologies (Taizhou) Co. Ltd.
The plaintiff says policyholders Barry and Joan Bara discovered a "substantial" amount of water in their residence on Jan. 12, 2012, and a subsequent investigation into the source of the water revealed the water supply line for a toilet in the house "had failed."
"More specifically, the plastic coupling nut on the water supply line had cracked, resulting in the uncontrolled release of water into and throughout the property," the original petition says.
"The water caused significant damage to the Baras' real and personal property."
It adds an engineer arrived at the conclusion that "the failure of the plastic coupling nut resulted from design deficiencies."
Consequently, the insurer seeks $15,152.32 in damages.
Attorney Craig M. Schumacher of Carpenter & Schumacher P.C. in Plano is representing the complainant, and Galveston County 10th District Court Judge Kerry L. Neves is presiding over the litigation.
