A Beaumont man has filed a lawsuit claiming that Wells Fargo violated federal law by placing daily telephone calls to his cellular telephone.
LaMarr Donald filed suit against Wells Fargo Bank N.A. on Nov. 15 in the Eastern District of Texas, Beaumont Division.
Donald claims that Wells Fargo contacted him by placing numerous daily telephone calls to his cellular telephone.
According to the lawsuit, the defendant contacted Donald using an automated telephone dialing system. The telephone would ring once or twice and when Donald would answer, the call was abandoned, the lawsuit states.
Donald requested that the defendant cease all calls to his telephone but the calls continued.
The defendant is accused of repeated violations of the Telephone Consumer Protection Act for using an automated telephone dialing system when Donald did not give express consent.
The plaintiff is seeking an award of statutory damages and treble damages.
Donald is represented by Jody B. Burton of Lemberg & Associates in Stamford, Conn.
A jury trial is requested.
U.S. District Judge Marcia A. Crone is assigned to the case.
