Lawsuit states defendant not abiding by settlement agreement

GALVESTON - Two local men who faced off in a lawsuit almost four years ago are engaged in another legal battle, according to recent court documents.

Eddie Baghalian sued Tyron Collins and a "number of other defendants" in Galveston County District Court in May 2010, but the parties immediately reached a settlement of $195,000.

In a suit filed Nov. 18, Baghalian accuses Collins of underpaying the amount in question.

Collins reportedly consented and became obligated to pay the plaintiff the subject funds in four payments.

According to Baghalian, the respondent paid the initial $25,000 and failed to comply with three remaining payments of $56,666.67, rendering at least $140,000 outstanding.

"The defendant has failed to make proper payments and continues to hold the plaintiff's funds and not release it," the original petition says.

"The plaintiff in good faith attempted to resolve any disputes and the defendant has chosen to litigate this matter."

Attorney Pejman Maadani of Maadani Law PC in Houston is representing the complainant, and Galveston County 10th District Court Judge Kerry L. Neves is presiding over the case.
