Driver sued after rear ending car in a construction zone

Two people are suing after they are injured when a driver rear ends another vehicle in a construction zone.

Robert S. Stuart and Kourtney D. Johnston filed a lawsuit Dec. 5 in Jefferson County District Court against Key Energy Services LLC and Justin M. Barrow. 

The plaintiffs say on Aug. 2, Stuart was traveling on the 7400 block of Fannett Road and slowed and stopped at the direction of Johnston, who was acting as a flagman directing traffic in a construction zone.

The complaint states that as Stuart was stopped the defendant, Justin M. Barrow, struck Stuart's vehicle from behind causing Stuart injuries.

The complaint also states that Johnston was injured when she jumped out of the path of the vehicles to avoid being struck when they collided.

The plaintiffs are seeking an undisclosed amount of damages.

They are being represented in the case by attorneys Langdon Smith and Frank Robertson of Jim S. Adler & Associates.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
