Recent patent infringement cases filed in the Eastern District of Texas

Dec. 26 

• ComCam International Inc. vs Brivo Systems LLC Case No. 2:13-cv-01132-JRG

Plaintiff ComCam International is a Delaware corporation with a principal place of business in Exon, Penn.

In the complaint, Brivo Systems is accused of infringing on U.S. Patent No. 6,975,220 for an Internet Based Security, Fire and Emergency Identification and Communication System.

The plaintiff is seeking compensation for Brivo’s alleged infringement, no less than a reasonable royalty, together with interest and costs.

A  jury trial is requested.

Plaintiff Fego is a company formed and located in Taiwan.

Defendants are accused of infringement of U.S. Patent No. 7,680,629 issued March 16, 2010,  and U.S. Patent No. 8,070,430 issued Dec. 13, 2011, both for a System and Method for Providing Notes in Measurement Devices.

The complaint alleges the defendant has been and is now infringing the patents-in-suit by, among other things, directly or through intermediaries, making, using, importing, providing, supplying, distributing, selling, and/or offering for sale apparatuses and systems (including, without limitation, UP24, UP, and the related applications) for providing a measuring device with the capabilities of note taking, at least one measuring component, a note control component, and a CPU, adapted to link the measuring event to a note.

Fego is asking the court for a permanent injunction enjoining defendants from infringement and a judgment for damages, costs, expenses, interest and other relief.

A jury trial is demanded.

Plaintiff RecruitME is a Texas limited liability company with a principal place of business in Plano.

The plaintiff claims it is the owner by assignment of U.S. Patent No. 5,623,660 issued April 22, 1997, for a System for Regulating Access to Data Base for Purpose of Data Base Management. The suit alleges the defendant has infringed the '660 Patent.

RecruitME is seeking a permanent injunction, damages, costs, expenses, interest and other relief.

A jury trial is requested.

Plaintiff Remote Locator Systems is a Texas limited liability company located in Plano.

CoverTrack is accused of infringing on U.S. Patent No. 5,548,637 issued Aug. 20, 1996, for a Method and Apparatus for Locating Personnel and Objects in Response to Telephone Inquiries. The defendant allegedly infringes the '637 Patent through its CDMA/GSM/GPRS Cellular Network and GPS Tracking Devices.

Remote Locator is seeking damages, costs, interest and other relief. A jury trial has been requested.

Tejas Research is seeking a permanent injunction, damages, costs, expenses, interest and an accounting of ongoing post-judgment infringement. A jury trial is requested.

Plaintiff Z-Dimensional is a Texas limited liability company with a place of business in Allen.

Defendants are accused of infringing U.S. Patent No. 7,729,530 issued on June 1, 2010, for Method and Apparatus for 3-D Data Input to a Personal Computer with a Multimedia Oriented Operating System.

Mercedes-Benz is allegedly infringing the '530 Patent through its S-Class sedans equipped with the Road Surface Scan/Magic Body Control systems and products. Defendant Microsoft is allegedly infringing the patent through Kinect systems, UltraCam and UltraNav systems.

Z-Dimensional is seeking damages, costs, expenses, interest, enhanced damages for willful infringement, attorneys' fees and other relief. A jury trial is requested.

• ON Semiconductor Corp., Semiconductor Components Industries LLC vs CMOSIS NV, Alliedsens LLC, Leica Camera AG Case No. 2:14-cv-00001

Plaintiff ON Semiconductor is a Delaware corporation with its principal place of business in Phoenix, Ariz. The company designs, manufactures and markets a comprehensive portfolio of semiconductor products including CMOS image sensors used in applications such as digital cameras, medical imaging systems and security devices.

The defendants are accused of infringing on:

• U.S. Patent No. 5,933,190 issued Aug. 3, 1999, for Pixel Structure, Image Sensor Using Such Pixel Structure and Corresponding Peripheral Circuitry;

• U.S. Patent No. 6,011,251 issued Jan. 4, 2000, for a Method for Obtaining a High Dynamic Range Read-Out Signal of a CMOS-Based Pixel Structure and Such CMOS-Based Pixel Structure;

• U.S. Patent No. 7,408,195 issued Aug. 5, 2008, for Semiconductor Pixel Arrays with Reduced Sensitivity to Defects; and

• U.S. Patent No. 7,608,516 issued Oct. 27, 2009, for a Semiconductor Pixel Arrays with Reduced Sensitivity to Defects.

According to the complaint, ON Semi obtained the patents through its acquisition of Cypress Semiconductor Corp. BVBA. Cypress has since changed its name to ON Semiconductor Image Sensor BVBA. All rights to the patents are assigned to ON Semi.

The complaint states that several key employees left Cypress to form CMOSIS, including the inventor of the '195 and '516 Patents, Guy Meynants. Meynants is currently the vice president of Research and Development and chief Technology Officer of CMOSIS.

ON Semi is seeking damages caused by defendants' infringement including pre- and post-judgment interest, costs, expenses, attorney's fees and other relief. A jury trial has been demanded.

Plaintiff NPT is a Texas limited liability company located in Plano.

The defendants are accused of infringing on U.S. Patent No. 6,442,485 issued Aug. 27, 2002, for a Method and Apparatus for an Automatic Vehicle Location, Collision Notification and Synthetic Voice through its Golf Buddy World Platinum II GPS Rangefinder.

NPT is seeking damages no less than a reasonable royalty, interest, costs, expenses, attorneys' fees and other relief. A jury trial is requested.
