The Board of Trustees of the Galveston Wharves filed suit in the Galveston County District Court on Jan. 22, naming INCA Refining LLC as the defendant.
In its complaint, the wharves state they are a local governmental entity with its principal place of business on Rosenberg Avenue in Galveston. INCA is allegedly a company out of Houston.
The board says it allowed INCA to store some of its refinery equipment on the Wharves property at the port. However, in 2013 the Wharves decided to end the agreement with INCA and sent a letter informing INCA that it needed to remove the property by Oct. 7. When the time came, INCA failed to remove the property and the Wharves initiated this litigation, the suit states.
The Wharves are seeking a court order requiring INCA to remove its cargo from the Wharves' property.
The Wharves are being represented by the attorney Anthony P. Brown of McLeod, Alexander, Powel & Apffel PC in Galveston.
