Plaintiff Presqriber is a Texas limited liability company with its principal place of office in Tyler.

U.S. Patent No. 5,758,095 for an Interactive Medication Ordering System.

Defendants have infringed the ‘095 Patent by making, using or selling electronic health record systems that have achieved ONC-ATCB Certification for Ambulatory and Inpatient medical practices.

According to the complaints, the ‘095 Patent is a “prominent, pioneering patent in the medical systems field, and has been forward-cited in more than 200 subsequently issued U.S. Patents to date and continues to be forward-cited to this day.”

Presqriber is seeking injunctive relief, compensatory damages, enhanced damages, interest, costs, attorneys’ fees and other relief to which it may be entitled. A jury trial is requested.

Smartflash LLC and Smartflash Technologies Ltd. v Google Inc., Gearbox Software LLC and Bonus XP Inc. Case No. 6:14-cv-00435

Plaintiff Smartflash LLC is a Texas limited liability company with a place of business in Plano. Plaintiff Smartflash Technologies Ltd. is a limited company organized under the laws of the British Virgin Islands with a principal place of business on the Island of Tortola.

Defendants are accused of infringing the following patents-in-suit:

U.S. Patent No. 7,334,720 issued Feb. 26, 2008, for Data Storage and Access Systems;

U.S. Patent No. 7,942,317 issued May 17, 2011, for Data Storage and Access Systems;

U.S. Patent No. 8,033,458 issued Oct. 11, 2011, for Data Storage and Access Systems;

U.S. Patent No. 8,061,598 issued Nov. 22, 2011, for Data Storage and Access Systems;

U.S. Patent No. 8,118,221 issued Feb. 21, 2012, for Data Storage and Access Systems; and

U.S. Patent No. 8,336,772 issued Dec. 25, 2012, for Data Storage and Access Systems.

Smartflash LLC and Smartflash Technologies Ltd. own all rights and interest to the patents-in-suit, according to the complaint. The patents-in-suit generally cover devices, methods and systems for transmitting, retrieving, downloading, storing and accessing content, content information, DRM data, payment data and supplementary data.

Defendant Google has committed acts of infringement with any version of its Google Play Store, including Play Music, Play Movies, Play TV, Play Books, Play Games, Play Apps and Play Newstand, the suit alleges. Defendant Gearbox Software has committed acts of infringement with its Borderworlds app that runs on Google devices and defendant Bonus XP infringes through its Monster Crew app, according to the plaintiff.

Smartflash is seeking a permanent injunction against defendants, compensatory and supplemental damages, attorneys’ fees, costs, interest, enhanced damages for willful infringement and other just and proper relief. A jury trial is requested.

The plaintiffs are being represented by Bradley Caldwell, Jason Cassady, John Austin Curry and others from Caldwell Cassady & Curry PC in Dallas, and T. John Ward and T. John Ward Jr. of Ward & Smith Law Firm in Longview.

The case has been assigned to District Judge K. Nicole Mitchell.

Plaintiff Uniloc USA Inc. is a Texas corporation with its principal place of business in Tyler. Plaintiff Uniloc Luxembourg S.A. is a Luxembourg public limited liability company with its principal place of business in Luxembourg.

According to court documents, Uniloc has researched, developed, manufactured and licensed information security technology solutions, platforms and frameworks and owns and has been awarded a number of patents.

Its technology is used in several markets, including software and game security, identity management, intellectual property rights management and critical infrastructure security, according to the complaints.

Defendants are accused of infringing on U.S. Patent No. 5,490,216 for a System for Software Registration.

Uniloc is seeking compensatory damages, costs, interest and other relief deemed just and proper. A jury trial is requested.
