C&D Skilled Robotics sues to recover unpaid commissions from tire contract

Breach of contract

A Beaumont company is suing to recover money it claims it is owed by a Michigan company.

C&D Skilled Robotics Inc. filed a lawsuit May 20 in the Jefferson County District Court against TGW Systems Inc., citing breach of contract. 

According to the complaint, on May 8, 2008, the two companies entered into an agreement in which C&D was to receive a 5 percent commission for all equipment, engineering and installation services provided by TGW in the tire industry.

Since the agreement was written, TGW has conducted business, including a $20 million contract with Goodyear Tire & Rubber Co., but has failed to pay any commissions to C&D, the suit alleges.

On Oct. 26, C&D claims it sent TGW an invoice for unpaid commissions totaling approximately $715,589, but has failed to hear from the defendant regarding the outstanding amount. C&D contends this behavior constitutes a breach of contract, according to the suit.

The plaintiff is seeking damages of at least $715,589, plus costs.
