Missouri company sued over refund not paid on medical equipment

A Jefferson County hospital is suing over claims a requested refund on purchased medical equipment has failed to be returned. 


Baptist Hospitals of Southeast Texas filed a lawsuit May 22 in the Jefferson County District Court against Surgioscopy LLC and Dave Shaw, citing breach of contract.


According to the complaint, the plaintiff bought the ViKY ROBOTIC System XL-UM and related software from the defendants for $75,000 in 2012 with a 90-day money-back guarantee.


The plaintiff says they requested a refund within 90 days, but the defendants delayed the process before setting up the refund in incremental payments, some of which were denied for insufficient funds. The defendants are accused of breach of contract, breach of warranty and fraud.


Baptist Hospitals of Southeast Texas is seeking more than $100,000 in damages and the remaining refund owed.


It is being represented in the case by attorney Reagan M. Marble of Orgain Bell & Tucker LLP in Beaumont.
