Traveler files suit after chair at regional airport collapses

A man says the designer and engineers of a chair used at the Jack Brooks Regional Airport, and the operators of the airport, Jefferson County, are responsible for injuries he sustained when a chair he was sitting in broke.


Jack Atkins filed suit Aug. 1 in the Jefferson County District Court against MaxDesign, Sigma Engineers Inc. and Jefferson County, claiming negligence.


According to the complaint, Atkins was sitting in a chair at the Jack Brooks Regional Airport on July 31, 2013, when he says the back of the chair broke, he fell and was injured.



The "Ricciolina" chair was designed manufactured and sold by MaxDesign, which was negligent in the design and manufacturing of the chair, according to court papers.


Sigma Engineers sold the chair, which was defective in design, manufacture or marketing, and the defendant Sigma Engineers was also negligent in connection with the selection, sale and marketing of the chair in question, the suit states.


Defendant Jefferson County, as operator of the airport and owners of the chair, was negligent in using a defective product.


As a result of his fall, the plaintiff sustained injuries that led to medical and hospitalization expenses, lost wages and/or loss of earning capacity, physical pain and anguish, physical impairment and loss of household services and consortium.


The plaintiff seeks a judgment in excess of the minimum jurisdictional limits of the court, pre- and post- judgment interest and costs.
