Woman sues intoxicated driver involved in vehicle crash

A Galveston County woman says she was injured as a passenger in a vehicle one defendant hit while driving under the influence of intoxicants.


Christina Marie Conner filed suit Aug. 4 in the Galveston County District Court against Shawn Jason Wark and Lisa Wark.


The lawsuit says Conner was a passenger in the front of a car driving southbound on FM 646 when defendant Shawn Jason Wark, traveling northbound, atempted to make a left turn before a marked intersection and veered into the southbound lane of travel, hitting the other vehicle in the passenger side where the plaintiff sat.


Police investigated and determined Shawn Wark was intoxicated above the legal limit, according to the suit. The plaintiff claims Conner was seriously injured as a result of Wark's negligence by failing to yield to oncoming traffic while making a left turn, failing to make timely and proper application of the brakes, failing to keep a proper lookout, failing to control his vehicle and stay within his lane of traffic and for operating the vehicle while intoxicated.


Defendant Lisa Wark was negligent, court papers say, because she entrusted her vehicle to defendant Shawn Wark, who was an incompetent driver and she knew or should have known he was an incompetent or reckless driver, according to the suit.


The plaintiff seeks compensation for medical, hospital and pharmaceutical charges and expenses in the past and that will be incurred in the future, for loss of earning capacity in the past and future, pain and suffering, mental anguish, physical impairment and disfigurement as well as exemplary damages. The plaintiff also seeks pre- and post- judgment interest and court costs.
