San Antonio family sues driver, alleging negligence caused accident

A San Antonio family is suing a Plano motorist, alleging his negligence caused an automobile collision.

William Carter, Joanne Carter, Pamela Carter and as friends of two minor children, filed a lawsuit June 15 in Galveston County District Court against Dominic Lee Burke, of Plano, alleging vehicular negligence.

According to the complaint, on June 15, 2013, the family was in a vehicle traveling south on South Gulf Freeway in Galveston County when the driver slowed due to heavy traffic in front of him. Burke, who was driving behind the plaintiffs, rear-ended the plaintiffs' vehicle, the suit says.

The lawsuit states Burke failed to control his speed and failed to maintain a safe distance between the vehicles, thus causing the accident. The suit says the defendant was negligently operating his vehicle by speeding and not maintaining a safe distance, causing injuries to every person in the Carter vehicle.

The Carters seek a jury trial, between $100,000 and $200,000, plus fees and court costs for each of the five passengers in the vehicle. They are represented by attorney Howard E. Davis of the Law Office of Howard E. Davis in San Antonio.
