Damages sought after plaintiff struck by vehicle

Carwash

A Galveston County woman is suing a business over claims she was injured when a vehicle driven by an employee hit her while she walking to her vehicle.

Petra Garcia filed the suit June 19 in Galveston County District Court against Devil River Inc., doing business as Bay Bright Car Wash & Detail Center, based in Houston.

According to the complaint, the plaintiff was having her car washed on June 7 when she claims that employees who had just dried her vehicle told her she was ready to go. She states that she was walking to her vehicle when another employee, driving a company vehicle, struck her, knocking her to the hot pavement, and then running her over. Her injuries immobilized her and the pavement burned her skin, the complaint states.

As a result, plaintiff is charging the defendant with negligence because it failed to exercise ordinary care so as not to endanger the safety of others.

She seeks damages for past and future medical care for injuries she says are permanent, court costs and other relief as the court decides.

Plaintiff's attorney is Steven M. Polotko, of Nicholas & Polotko, LLP in Houston.

Galveston County District Court case number 15-CV-0629.
