Crane operator's complaint blames loss of job of 24 years on age discrimination

Brazoria County resident Charles D. Stinson has initiated legal action against TIC – The Industrial Company, alleging he lost his job as a crane operator because of his age.

Stinson filed a lawsuit on Sept. 2 in the Galveston Division of the Southern District of Texas. The suit explains that Stinson, who is in his mid-70s, was continuously harassed with remarks about him being “old” prior to the termination in question.

The plaintiff worked for TIC for almost 25 years and possessed a pristine work record, according to the suit.

Court papers further recall an incident on Oct. 25, 2014 in which a load he was supposed to turn over “had been improperly rigged by another employee.”

“This employee is more than ten years younger than the plaintiff,” they say. “Due to the improper rigging, the load was unstable during the lift and the lift was stopped.”

Stinson says the aforementioned rigging was not problematic, but a colleague reported him.

TIC terminated the complainant on Nov. 5, 2014 and purportedly replaced him with a work a decade his junior.

“Not only did TIC not take remedial action sufficient to stop this discrimination, but by and through its employees, officers and supervisors, aided and abetted this discrimination by inciting and encouraging additional discrimination as well as retaliation against their victim,” the original petition says.

Consequently, Stinson seeks unspecified monetary damages and a jury trial.

He is represented by attorneys Charles H. Peckham and Mary A. Martin of the law firm Peckham, PLLC in Houston.
