A Bosque County man is suing a drilling services company, alleging unpaid overtime wages.
Dustin Morgan, individually and for all others similarly situated, filed a collective action lawsuit Aug. 31 in the Houston Division of the Southern District of Texas against Xtreme Drilling and Coil Services, Inc., alleging unpaid overtime wages and failure to maintain accurate records.
According to the complaint, while Morgan was employed by the defendant from April 2013 to August 2015, as a ground hand, pump operator, an equipment operator, and finally, a lead operator, he regularly worked more than 40 hours per week.
The suit says Morgan was paid a fixed salary wage, regardless of the number of hours he worked, until April 2015, when he was switched to an hourly basis until the end of his employment. During the months he was paid an hourly wage, he received an overtime rate that was less than time-and-a-half, the complaint alleges.
Further, according to the suit, the defendant failed to maintain accurate time and pay records as required by law.
Morgan and others in the collective seek unpaid overtime compensation, liquidated damages, attorney fees and costs. He is represented by attorneys Melissa Moore and Curt Hesse of Moore & Associates in Houston.
