A Galveston County outdoor advertising company is suing a business and an individual, alleging lack of payment for billboard space.

Gilbreath & Company, doing business as Gilbreath Outdoor Advertising, filed the lawsuit Sept. 2 in Galveston County District Court against Aegis Credit Services Inc. and Larry Benham.

According to the complaint, on April 29, Benham entered into a contract for $21,000 for advertising and lease space on billboards. Although it has a contract signed by the defendant, the plaintiff alleges it has never received a payment, constituting a breach of contract on the part of Aegis Credit.

The suit also says the defendant used the corporate name Aegis Credit Services Inc., to perpetrate a fraud upon the plaintiff for the defendant's personal benefit. The plaintiff wants the defendant to be held liable to pay any damages attributed to Aegis Credit Services Inc.

Gilbreath Outdoor Advertising seeks actual damages, lost profits, court costs and attorney fees. It is represented by attorney Rich Melendez of Melendez Law in Houston.
