Seabrook man sues insurance company, alleging underpayment for hurricane flooding

A Seabrook man is suing his insurance company, alleging it refused to pay for hurricane-related flooding that damaged his home.

Marvin Gibson filed the lawsuit Sept. 2 in the Houston Division of the Southern District of Texas against Empire Indemnity Insurance Company of Schaumburg, Ill., alleging breach of contract.

According to the complaint, on Sept. 13, 2008, Gibson's property at 1744 Islander Way, Seabrook, flooded as a result of Hurricane Ike. The suit says Gibson had flood insurance through Empire Indemnity and filed a claim after the storm.

The defendant sent an insurance adjustor, who, the lawsuit says, did not account for all damage to his property. The check the defendant gave Gibson for damages remains about $35,000 short, the suit states.

Gibson seeks the full value of his lost or damaged property as a result of the flood as well as other relief the court may deem appropriate. He is represented by attorney Jason M. Ciofalo of The Ciofalo Law Firm in Tampa.
